Likelihood of conviction is estimated to be around 99.9 percent

Nine individuals are on trial in China for buying a kidney from a teenager who was looking for money to buy Apple, Inc.'s (AAPL) popular iPad and iPhone.  

The 17-year-old surnamed "Zheng" had no college degree and would have made only around 1-1.5k RMB (CN¥) ($157-236 USD) per month, hence requiring several months of hard work (assuming he could save all his money) to pay for the slick devices.  Instead, the teenager chose to make a rash decision and sold his kidney in an illegal operation to purchase the slick status symbol.  The kidney was transplanted into a person of unknown nationality who has looked to skip donor wait lists via the black market.

When his mother found out, she was furious and retained a lawyer.  Her lawyer is requesting 2.27M RMB (CN¥) (~$357K USD) in compensation.

Prosecutors in the Beihu district court in the inland southeastern province of Hunan said that those involved "should be held criminally liable for intentional injury".  A 2010 U.S. State Department report estimates that 99.9 percent of people who stand trial in China are found guilty.

Surgeon Song Zhongyu reportedly made 52,000 RMB ($8,175 USD) off the transplant; Su Kaizong, the hospital urology dept. contractor, scored 60,000 yuan ($9,430 USD); and the go-between man He Wei received 56,360 ($8,860 USD).  He Wei is described as a man "penniless and frustrated over gambling debts."

Two other defendants also received smaller cuts -- their role was unclear. Two nurses, a surgical assistant, and an anesthesiologist from the hospital have also been charged for their roles in the operation, though it's unclear how much illegal compensation (if any) they received.  The victim received only 22,000 RMB (CN¥) ($3,460 USD), only about a tenth of the total money scored by the hospital staff.

That takes the defendant total to 9 individuals -- most of which have close ties to the district hospital.

The hearing has finished and the defendants and prosecutors are now awaiting the verdict, which will almost certainly be "guilty".

Black market organ trade has been widely reported to be occuring in China, but this is one of the first times the issue has received significant attention from Xinhua, China's state-run news agency.

The human body can adapt to the loss of a kidney, but the problem posed by black market operations is that individuals are typically not screened for health risks [source] that could be inacerbated by the donation.  In the worst case, donation from an unhealthy donor could lead to failure of their remaining kidney, illness, and even death.

I feel no sorrow for this man. He is old enough to realize the consequences of his actions and yet, voluntarily, let them remove his organ.

Most children would realize that allowing a stranger to cut you open and remove pieces of you is not worth a shiny new toy.

If he was mentally deficient / retarded, then this might be a different story...

I actually feel bad for the medical staff, most of which appearantly made no money at all and were probably conned into thinking the proceedure was a routine kidney removal. Who knows, the medical review might have been completely scripted by the middleman and somebody in the hospital got it in queue.

Sure, its speculation, but it's my opinion if people want to sell their body parts...so be it. Nine other people, some of which could be completely innocent (nurses are often left in the dark about certain proceedures and history even in the United States) should not be punished but this boy's complete lapse in judgement.

Furthermore, what percentage of that 250k USD compensation fee is going to the lawyer. I hate hate hate blood thirsty lawyers like this. If that money is going to be reallocated from the hospital to his pockets, that, in my opinion, is criminal. How many people are going to die because of cuts in hospital funding to pay the 250k debt? That figure is a huge blow to even a medical facility in China.

Anyone who's buying organs from the black market knows that there's a risk of infection, so honestly it's likely only illegal because the hospitals can't make thousands of dollars per surgery.

Actually it is funny, when you understand why. Its a reference to Apples 'everyone is copying me' Android lawsuits. It's funny because its laughably improbable in anoyone but Apples eyes, amongst other reasons.

I've been on this site only a few hours, so I have no idea of this guys track record, but yeesh, you lot are being a bit harsh at a slightly off-color but funny joke aren't you?

I feel like people use Troll as the grab at name to give people when they want to feel smarter than them and have nothing else to say.

I agree it wasn't at all funny. It was not in poor taste though. People need to stop being offended by everything and stop the constant walking on eggshells.

As I will agree the joke wasn't funny I will not agree with everyone being such a damn sally and getting mad at you. I am so tired of the P.C. BS. I'm sorry but if you consider somebody who's willing to let one of his organs be cut out to get a new toy, especially an iProduct, not mentally retarded, then i don't know what is.

Nor would i consider anybody who would voluntarily let such a action be performed on him, of sound mind. It's not like they arrived on his doorstep "Right can we have your kidney then?".

It will never happen ofcourse, but i'd like to see this sued all the way to Apple themselves. For hyping the product up enough for this to happen. I mean how on earth did he ever come to belive those toys where more important then a kidney? In other words, why did he trade his kidney for an ipad/iphone and not a cheaper competitor's product?

Is an iPhone the thing to get, even if it costs you a kidney?

In the end though i feel no sorrow for the guy either. Like anybody cares what happens in china. The olympics are in london this year!

While I agree its nuts...many people today have already given up free will to own an Iproduct. This is just a more extreme example of how stupid people have become in obtaining "Stuff" to be part of some group or to be seen in a different light in their mind. How much stuff do people buy today that they could truly live without. Lots of stuff. Just look around at the fashionistas and the tech stuff they own. Who in their right mind pays hundreds of dollars for a headset....but look at the number of Beats by DRA headsets. Of course any intelligent person knows that celebrity is given them as a marketing ploy.

Generally speaking.....people are dumber these days. Just take a look around you when your in public. Lack of respect for others is rampant.

Granted, the main motivation was an iProduct, but if you actually read, he made over $3000, in a place where his income amounted to $200 a day.

Sure he may have been immature enough to spend that on a toy, but that could have been life changing money over there if spent correctly.
