Apology will have to wait for appeal to be heard
Adding to Samsung Electronics Comp., Ltd.'s (KSC:005930) legal woes this week, Apple, Inc. (AAPL) scored a stay of a London national court's order which would have required it to print apologies to Samsung on its website and in major newspapers.
The stay does not negate the decision, but it shelves it until Apple's appeal is heard in October.
Judge Colin Birss called Apple's design claims ludicrous, writing, "[The Galaxy Tab line] do not have the same understated and extreme simplicity which is possessed by the Apple design... They are not as cool."
Apple claims printing an apology would be tantamout to printing an advertisement for Samsung. Its failed litigation, currently being appealed, is based on Community Design 000181607, which depicts a rectangular tablet:

It claims Samsung's tablets "stole" the look in that patent. It is also appealing the London court's decision to invalidate three of its patents, software technology patents which it was also using to sue Samsung.
