Court makes ruling after agreeing with Samsung that Apple's false statements could have caused harm

While the insanity continues in the U.S. with Apple, Inc. (AAPL) being granted software patents with little care for reason, in the United Kingdom sanity has slowly been restored, thanks to proactive London courts.

In recent weeks Apple saw UK courts order its design patent narrowed and many of its European Union software patents invalidated.  There would be no bans of Android tablets or smartphones based on Apple's tenuous, and often painfully obvious "invention" claims, the judges ruled.

The decision only applies to the UK, as in the EU patents are granted first by regulators with the union's intellectual property body, then reissued as identical patents by each member-state.  In other words, only the UK copy of the European Patent was invalidated.  But the decision has a strong likelihood of informally swaying the decisions of courts in other member states, given the UK's leading economic role in the EU.

To add insult to injury, the UK court has ordered that Apple print an apology to Samsung Electronics Comp., Ltd. (KSC:005930) in several major newspapers, acknowledging that its competitor's design was not a copy of the iPad.

Samsung’s lawyer Kathryn Pickard complained at a UK hearing that Apple's highly publicized claims that Samsung had "stolen" the iPad design "caused real commercial harm."

While late Apple CEO Steve Jobs accused Samsung of "stealing" his company's ideas, vowing "thermonuclear war", Samsung has never admitted to doing such a thing.  By contrast Mr. Jobs himself  brazenly bragged of his company's lust for stealing others' work, "Picasso had a saying - 'Good artists copy, great artists steal.' And we have always been shameless about stealing great ideas."

The court agreed with Samsung's assessment that Apple had harmed it with lies.  It ordered Apple to pay for notices in four of the nation's top newspapers/publications --  Financial Times, the Daily Mail, Guardian Mobile magazine, and T3.  A draft must be sent to Samsung's lawyers for approval.

Apple must also print a notice on its UK homepage for six months stating that Samsung's tablets are unique and do not copy its iPad.

Richard Hacon, Apple's lawyer bemoaned the ruling, saying it would amount to "an advertisement" for Samsung.  He commented, "No company likes to refer to a rival on its website."

Apple's lawyers of late have been open in acknowledging how difficult it is for their company to keep up with its more lively South Korean rival, commenting, "Samsung is always one step ahead, launching another product and another product."

Sadly for those lawyers, their dream of trying to catch up by banning the competition have been rewarded with a public-relations nightmare.

Yeah, I still complain because stock Android 2.3 on my brand new Galaxy Note was batshit ugly and totally unusable. I haven't seen worse looking and behaving mobile OS in my life, even BB7 is way nicer and faster, and Android 4.0.4 still can't render web pages with animated gifs and italicized fonts correctly, both stock browser in 4.0.4 and Chrome have errors and bad rendering of some kind, so I constantly switching between 'em which is fucked up, never done this on BB7 ever! And ICS UI speed is still crap, it's laggy compared to WP7.5. So yeah, I have something to complain about and I don't care if you stay blind to OS defects or not. I can see them and that's enough for me.
Android 4.1 is the best mobile OS
I don't give a fuck 'coz my Galaxy Note won't get it (Samsung will never do this 'coz they have Galaxy Note 2 to sell and they DO NOT want ppl to download 4.1 on their Galaxy Note instead of buying Galaxy Note 2), and IF it gets it much later as a Cyanogenmod I'm going to get stuck with a fucking dead stylus support 'cause fucking Samsung software needs that closed source TouchWiz shit to operate properly and you need Samsung software if you wanna use stylus.

Jelly Bean is good only for the owners of Google branded Nexus phones, but these have kinda crappy screen, too small for me :) So for me, on my highest end current Android device there is NOTHING in that Jelly Bean goodness. And won't be for a long time. Don't forget it's not Apple where they get OS for their device immediately after release. There is a price to pay for that zoo of Android hardware.

Well, you've run the gambit and used them all and found them all to be lacking. Every single mobile OS has a laundry list of problems for you. I dont know what to tell you. MAybe you shouldnt use a smartphone, or just go with "As good as you can get".

I told you to wait. You bought a year old phone, its not like you thought there would be an upgrade... There is always cyanogenmod10. It will come soon enough.

Glad my SGS3 is getting Jellybean, already announced that tehy will be upgrading it on all carriers. :P Its not "just" the Nexus, even the note 2 will have it.

Stop complaining and enjoy your phone, it has a brilliant screen and a decent OS... I almost got a note as well, even compared to the SGS3, the note screen is almost enough to make me a bit jealous of your phone.

Like I said, Jellybean is as good as it gets for a mobile OS in 2012. Since you appear to be very demanding and hard to satisfy, I don't think buying last years model is a good idea for you.

Yah I'll enjoy my Android phablet until WP8 phablet comes along. That's right I'm demanding when I use my OS and if it's not slick and fast enough I'll say bye bye to it sooner or later. The Jelly Bean in Cyanogenmod 10 without Samsung's software that enables stylus is not gonna help either.

This I understand, but none of them seem to be good enough for you LOL. Dont count on WP8 being the savior, it is still MS.

Nah I don't count on it, I totally expect MS to fuck it up yet again resulting in me being stuck with my Note with non-working stylus and Jelly Bean Cyanogenmod onboard. I wish Nokia or HTC did such a nice phablet as the Note but without stylus so that I wouldn't lose anything when upgrading to custom ROM like Cyanogenmod. My ideal phone doesn't exist yet as you can see. They all suck just in different areas. BB sucks with ancient OS, WP sucks in shitty old hardware with tons of stupid limitations, iOS sucks because of ugly screen and stupid glass on the back, and Android sucks because of ugly laggy UI and lack of timely updates if you are not using Nexus brand hardware. We'll see if they make a 5" 1280x768 phablet with WP8, maybe this one will be without all these disadvantages.

Hey I know already what sucks about it - no high end 3D games like Infinity Blade or Dark Meadow.But this is something that could be fixed in future, unlike my non-working stylus in Jelly Bean.

If you are struggling with how to use your Galaxy Note then maybe you should ask someone how to use it.

Folks are usually happy to help old folk on how to use the latest tech. It can be a struggle getting to grips with technology. I'm quite impressed you've managed to get to grips with posting on a forum Well Done!

Just don't be shy to ask.
