The Mannheim court in Germany has upheld the earlier ruling that Apple infringed on Motorola's patents

It looks like German citizens will have to go without push email via iCloud and MobileMe services.

Back in February, a German court ruled that Apple's iCloud and MobileMe services infringed on Motorola's European Patent (EP) 0847654 (B1), which covers a "multiple pager status synchronization system and method." The trial began in November 2011.

The push email services have been disabled since the February decision, and now, the Mannheim court in Germany has upheld the earlier ruling that Apple infringed on Motorola's patents. 


In addition to the ban on Apple's iCloud and MobileMe, Apple was ordered to pay an unspecified amount to Motorola in damages.

German Apple users will now have to manually retrieve email on their devices. Apple has offered some advice on how to set up gadgets to manually retrieve email on its support page.

The ruling is a pretty big blow to Apple, considering Motorola creates Android-powered devices.

Also, Apple has been battling other Android-powered gadget makers like Samsung over in Germany and around the world for some time now. Last year, Apple launched a lawsuit against Samsung claiming that the Android supporter was an "iPhone, iPad copycat."

Since then, the two have flung lawsuits back and forth throughout 2011 and 2012. Apple managed to successfully ban Samsung's Galaxy Tab 10.1 in Germany and Australia, but eventually lifted the Australia ban. Samsung later created a new Galaxy Tab 10.1N, which can be sold in Germany, but the original version remained banned.

Normally I'd say something along the lines of what you said, but seriously, Motorola's being a douche. Don't pretend for a moment that the Google subsidiary won't use this win against everyone else, even if neither Microsoft nor RIM has their guns pointed squarely at Android's head right now.

Just because someone plays dirty doesn't mean you have the rights to do the same. The way I see it, Motorola is worse than Apple right now because it wants Microsoft Windows banned in Germany and possibly followed by a blanket ban on Windows in Europe.

Instead of fighting a David pretending to be Goliath, Motorola wants to kill a Goliath. Infinitely worse.

You do understand Apple pretty much has a strangle hold on the business market? You also understand, not all companies are domestic (located ONLY in the country you reside)? Apple is an international company. So is Android. etc etc...

Given that Apple's iPhone and iPad are mainstream devices being used by many international Fortune 100 companies, many would agree, this is a big blow to Apple, even just being in Germany.

Hah! Do you know how many Android fans here will argue with you to death for saying Apple has dominance on the business market? Why, Android fans may mistaken you for suggesting that Apple's iPhone has a significant lead in market share than Android. Better make your required "I don't own any Apple products" apologetic statement quick before the Android horde gets to you.

And you have no idea what push email service is (which the banning rule applies only to Apple's Mail App) and how easy it is to find a work around and how incredibly insignificant it is to the whole iCloud services.

Plus, for most casual people push email services can translate to higher phone charges and have them disabled anyway. For business users then they can set their phones to check email intermittently every 5/10/whenever minutes and have their companies pay the bill. So there's a solution to a problem that's extremely trivial yet overly sensationalize because of DailyTech desperate need for page views.

That's what this is.

DailyTech knows that anything Apple related news tend to drive hundreds of its loyalists bat crazy hence increase page views. Bloggers like Jason Mick wouldn't have food on the table if he'd stop his Apple-bashing crusade. And I doubt any other media would ever hire him due to his incompetent writing skills alone.
