Apple Sues Kodak in Manhattan District Court, Takes Advantage of Film Giant's Poor Position

Apple asked a bankruptcy judge if it could file a patent infringement lawsuit against Kodak yesterday
As if repeatedly attacking Samsung, HTC and Motorola Mobility with patent infringement lawsuits wasn't enough, Apple is now looking to kick Kodak while it's down with digital camera, printer and digital picture frame-related infringement suits as well.
Apple's Valentine's Day present to Kodak was a filing in the U.S. Bankruptcy Court in New York yesterday, where Apple said it is filing
claims against Kodak with the International Trade Commission (ITC) as well as the U.S. District Court in Manhattan. Apple asked a bankruptcy judge for permission to sue Kodak first, despite the fact that filing for bankruptcy doesn't protect Kodak from infringement suits.
Apple had claimed before that it created a digital camera in the 1990's along with Kodak, but Kodak supposedly moved ahead with patenting the camera on its own. Apple had filed the case with the U.S. International Trade Commission in Washington, where the ITC rejected Apple's claims. Yesterday, Apple said in the filing that it wanted to move the case to Manhattan.
On January 19, 2012,
Eastman Kodak announced that it had filed for Chapter 11 bankruptcy protection
. The 131-year-old film giant filed in the federal bankruptcy court in the Southern District of New York after mentioning in November 2011 that it would be unable to pay its bills at some point in 2012 unless it stumbled upon some quick cash.
Just last week, Kodak announced that it was also
bailing on the digital camera market
as well as photo frames and pocket video recorders.
Kodak sent a patent infringement lawsuit back Apple's way last month, which also targeted Motorola Mobility. However, Apple argued that the ITC shouldn't even bother with the claims because of Kodak's bankruptcy filing and the sale of its patents. Kodak responded, saying that bankruptcy isn't stopping Kodak from expanding its digital imaging technology.
"Apple should not be using the bankruptcy to seek to disrupt Kodak's enforcement of its patents given that infringers like Apple, who continue to violate Kodak's intellectual property rights and refuse to properly compensate it, have contributed to Kodak's current circumstances," said Kodak.
Apple has been on a lawsuit crusade over the past year, mainly targeting Samsung. In April 2011, Apple began attacking Samsung with several patent infringement lawsuits in regards to the South Korean electronics maker's Galaxy S 4G, Epic 4G, Nexus smartphones and the Galaxy Tab 10.1. Apple claimed that these products imitate the iPhone and iPad.
Apple even successfully banned the Galaxy Tab 10.1 in Australia and Germany, but Samsung finally
lifted the ban in Australia
in December 2011. Samsung is still having troubles in Germany, however.

And yet oddly ( from your world view) even after people buy thier phones all surveys of post purchase satisfaction consistently show that iPhone users have much higher levels of satisfaction compared to Android handset buyers.
As I said iPhobics live in a delusional world where real world evidence counts for nothing and Apple's success and the success of their products is some sort of mistake brought about by voodoo marketing.
Time to go back on your medication perhaps.

I guess it is like another person here tried to warn me about. You only can see anything from one angle & even when countless people have shown you over & over again the many underhanded things Apple has done in the past. You either blindly defend them or change the subject & try to twist everyone's words to suite your needs. You sir are totally brain washed & I see no point in farther engaging in any kind of topic with you as you most likely walk around this world with your eye's closed & live in a world where everyone else is guilty except Apple.
There are many reports around that state facts about Apple but yet when these facts are put in front of you all you can most of the time come up with is calling every one iPhobics & almost never actually state anything that is useful that would explain to us why Apple is the way they are.
It is a proven point that Apple has a double standard when it comes to how they conduct their business but in your eye's this is ok but if another company does it to Apple then in your eye's it is not ok. I am sick of hearing or reading about Apple suing this company or that company for lame patents that should have not been granted or on patent ideas Apple stole form others that were invented years before Apple even thought up the idea in the first place. Yes other companies sometimes do the same thing but in most cases those companies are fined & forced to either give up the patent or license it out to other competing companies. In Apples case they simple refuse to license their patents out or they take others work tear it apart come up with a slick new coat of paint for it put a patent on another persons or companies idea & call it their own. They have dome this time & time again yet they are defended by people like you for doing it.
You will say oh reality check or something stupid like that when & if you decide to answer this post but I am pretty sure you will just side step the issue & dribble something in Apples defense yet again.
I really am going to hate it if Apple actually does get into TV's because from that point on everyone will be saying Apple created the TV & everyone else is copying them yet again. As stated in my last post some shallow brain waved guy already posted something like that in a Samsung HDTV article so don't say it won't happen because it is already starting.
As for you saying the iPhone user base are the happiest bunch that's to funny. I got 2 friends that got iPhone 4 S both of them totally hate the phones but they are stuck on long contracts & have to keep them for at least a year before switching to something else. They both most likely got sucked into that Siri crap but soon realized it is almost useless.
Oh please explain to me where Apple gets off trying to sue google for what was it voice search or something like that. You do realize google has had that long before Apple ever thought of it & I am not talking about on a phone I was doing it on my PC from Googles search long before Apple released the iPhone or even got some half baked patent for it. I guess its not who you know but who you pay off.
