Company will repay Samsung for lost revenue if it loses the case

Apple, Inc. (AAPL) has scored a major victory in latest round of lawsuits [1][2] courtesy of a ban on Samsung Electronics Comp., Ltd.'s (SEO:005930) Australian Android tablet sales.  

Google Inc.'s (GOOG) Android platform is outselling the iPhone 2 to 1 and is growing at a faster pace than Apple.  So Apple is now trying to stifle its competitor with lawsuits.  It is currently suing all three [1][2][3] of the world's largest Android handset makers.

This week, Samsung agreed to cease sales and advertising of its Galaxy Tab 10.1 in Australia, pending the outcome of a suit Apple filed against it in Australian court.  The suit is one of many that Apple has filed against Samsung in international courts.  

Like the other suits, in this one Apple contends that Samsung "slavishly" worked to steal its intellectual property, including its patented iPad design -- a thin rectangular tablet with a glass screen and black bezel.  Apple also claims Samsung stole its touchscreen technology.  In all 10 of Apple's patents are cited as being infringed.

Steven Burley, a lawyer for Apple, says the ban on sales was necessary as Samsung made "announcements of an imminent launch of the Galaxy Tab 10.1 device ongoing since July 20."

So far Samsung has not made similar agreements in the North America, Europe, or Asia.  However, Apple is pursuing a preliminary injunction banning sales in these regions.

Samsung is countersuing Apple.  The company has one of the world's largest patent portfolios and holds more U.S. patents than Apple.  Thus some legal experts believe Apple may have picked an intellectual property fight with the wrong company.

Apple chief executive and co-founder, Steven P. Jobs has bragged about his mastery of stealing ideas from others, stating [video], "Picasso had a saying - 'Good artists copy, great artists steal.' And we have always been shameless about stealing great ideas." 

Mr. Jobs contends Android handset makers like Samsung, HTC, and Motorola should not be allowed to "steal" the iPad and iPhone's copyrighted look and designs.  

Critics have contended that Apple's patents are so broad that they cover every smart phone and tablet in existence today, as well as non-mobile devices like personal computers.

Apple has agreed to pay Samsung unspecified damages for lost sales, if it loses the case.  It is unclear if this agreement would cover lost sales in the case of a "draw" -- a scenario, which could occur if both companies win their respective lawsuits, forcing a cross-licensing agreement.

Well, first of all, iOS is much more efficient than Android. I am a java programmer, and I know that java is a poor solution for GUI programming. Java makes coding easier, because it is managed code. You don't need to deal with managing memory directly in the code. You just instatiate objects and the JVM does garbage collection. You do have to make sure to close db connections and whatnot... Java has been used almost entirely on the server side, because managers found it is cheaper to scale up the hardware than to spend money on developers writing efficient code. This works fine on server side products, like web apps, but not so good with GUIs. Java for GUIs was in very limited use until Google decided to use Java, presumably because the easier to write code would make for more app development. Wrong. iOS still has more apps and better apps. Apps written by professional software companies, not some arse clown half way around the world...

I digress. The short answer is that iOS does not need as much processing power and memory to run with better performance than Android. It is clear to me, having used a few Droid handsets and tablets, that they could really use a faster processor to improve the sluggish UX.

This is the same crap that PC makers tried to do with their ad campaign where they sent people into a store with $X and asked them to buy a Mac or PC. They would complain that the Mac had less memory for the same price. It doesn't need gobs of memory, like resource hogging Windows. It is an efficient OS. I personally wish I got an iMac instead of a Mac pro, but I too was fooled into projecting Windows hardware requirements onto OS X...

A Mac with half the processor speed, half the memory, and half the disk space will run better than a PC. It will boot faster, shut down faster, and run apps faster than the Windows machine with better specs. Since the OS and apps don't take up as much disk space, you will get more out of a smaller hard drive. Even in terms of media, AAC is more efficient than MP3, so even your music will have a smaller footprint on a Mac than Windows. Popular Mechanics did a story on this a year or so ago... Google it...

You may be fooled by the hardware comparisons, but as long as it is running Android, it will need faster hardware to even attempt to run as fast and smooth as an iOS device.

4G LTE? Yeah, I bought into that for about 2 weeks. I got a 4G modem for home use, and it has a huge antenna and gets great reception, but the service itself is slow. I ended up returning it because it was slower than my 3G iPhone most of the time. Got the service from Clear, which is partly owned by Google, so I was paying $50/mo to beta test for Google. I cancelled the service and put in a dispute with my credit card company so all charges were refunded. 4g is pure crap in the U.S. If you do some research, we won't have a decent 4g service until 2015. Japan and a few other nations have viable 4g networks.

Go ahead, get the 4G LTE phone... It will most likely be using 3G in most areas, and if it does use 4g, you will see, during peak hours, it will be slow as can be. I was getting 0.3 Mbps on my wonderful 4G modem, provided by a "wonderful" company that is partly owned by Google.

Apple does not buy into bleeding edge bullcrap... They make the stuff that just works, and Google and pals make the stuff that you are paying to beta test. Have fun! Been there, done the 4G thing. I live in a major metroplitan area, the technological center of the world, and 4G SUCKS!!!

Speaking of Verizon, they don't even try to sell the iPhone. It sells itself. Those kiosks at Costco are desperately trying to pawn off Android iPhone knockoffs to people who don't know any better.

I mean, come on. This Samsung tablet is clealy made to look just like an iPad. Apple has every right to sue.

They pick their battles. They don't sue the PC makers that rip off the Mac Mini or iMac. Of course, those end up being huge. Sony's attempt to make an iMac rip off that runs Windows is hilarious. It's like five times as thick. Again, it needs more powerful hardware to run a crappy, bloated, slow OS like Windows. Android is similarly crappy, slow, and bloated. Those .apk's are much bigger and take up more storage space than iOS apps, and the equivalent iOS app is always better.

Android is like Windows, but with worse quality. It is bloated, slow, and takes up too much space. So you will always see Android devices with better hardware specs that perform poorly compared to an iOS device.

I'm amazed at how much you put into your reply. Do you have all this time to write because your iphone/ipad/airmac is so much more efficient and windows and android? If only tmobile had the iphone, I could be smart too.
