Bad boys, bad boys, whatcha gonna do? Whatcha gonna do when they come for you?

It's been a wild week for Gizmodo. The popular tech blog got what could be considered the tech scoop of the year (and possibly of the past decade) when it laid hands upon a prototype fourth generation iPhone.

According to Gizmodo's numerous stories on the topic, the phone was left behind at Gourmet Haus Staudt, a bar in Redwood City, California specializing in German suds. The person that found the phone tried to contact Apple directly in order to return the phone. The quest to find someone at Apple who could identify the lost prototype proved unfruitful.

Interestingly, the person who found the phone didn't hand the lost phone over to a bartender or appear to try to contact the person that actually lost the phone. The name of the person was gleaned from his Facebook profile on the iPhone and all of his pertinent information was available -- we know this because Gizmodo outed the Apple employee that actually lost the phone.

In the end, Gizmodo ended up paying $5,000 to the person that found the iPhone and ran with the story. Gizmodo later returned the iPhone prototype at the behest of Apple after it a finished a dissection.

According to Apple guru John Gruber, the iPhone in question is indeed a late prototype judging by its barcode:

One of the barcodes attached to the unit read “N90_DVT_GE4X_0493”. According to several sources (of mine) familiar with the project, “N90” is Apple’s codename for the fourth-generation GSM iPhone, slated for release this June or July. “DVT” stands for “design verification test”, an Apple production milestone. The DVT milestone is very late in the game; based on this, I now believe that this unit very closely, if not exactly, resembles what Apple plans to release.

Now, almost a week later, the police are involved according to CNET. Police in the Silicon Valley-area are now investigating whether the actions of Gizmodo and the person who found the phone were criminal and if there is enough evidence to file charges. The investigation is being headed by a computer crimes task force based out of the Santa Clara County DA's office.

CNET also reports that Apple has been in contact with the authorities regarding the incident.

The boys over at Gizmodo and Gawker Media are probably sweating a bit now that the police are involved, but the Apple employee who lost the phone may actually have a free getaway to Germany waiting for him. Lufthansa has offered the unlucky fellow a free flight to Germany where he can continue his love for great beer.

"At Lufthansa we also noted with great interest your passion for German beer and culture," said Lufthansa's marketing director for the Americas, Nicola Lange. "We thought you could use a break soon--and therefore would like to offer you complimentary business class transportation to Munich, where you can literally pick up where you last left off."

Apple is such a cry baby and so full of S**t! Someone loses their prototype phone, someone finds it and tries to do the right thing and then they turn around and try to get Gizmodo (innocent people) in trouble. This is the reason I don't buy Apple products, they are either suing or trying to get someone in trouble. They act like its a super weapong that they're developing.

Absolutely agree w/you. I bet you 10 to none that Jobs has a big smirk like that pic they show. Cops? Goody! Goody! (Rubs hands together) Now all get those Gizmodo bastards, and there puny employees too! (Mimics witch's cackle). But seriously, this could blow up to something big if Job gets his hands into it. He's looking for anything to protect his investment, and I'm sure that he's even considered putting up a little green into somebody's hands (hint, hint) to clear things up, and I wouldn't pass it up when it comes to him. It's snake-in-the-grass actions at it's finest!! Also, a big thumbs-up to getting the "victim" a free beer at the request of the beer-loving society of Germany. Where's mine? Not sure how you make out Gizmodo as innocent. They knew what this item was (hence their payment), they knew it didn't belong to the guy they were paying, once it was in their possession they failed to return it to the people they knew owned it until chased by the said owner. However you cut this they were not innocent.

I actually think that journalists should be protected in general when trying to dig up dirt on the great and mighty but stealing a prototype product just to drum up some viewers strikes me as a bit sleazy. What next - gusset shots of Mrs Jobs getting out of a car?

This is blown way out of proportion. It's just a new phone that makes calls and does a view more things. Imagine people getting that exited about a new toilet design. In the grand scheme of things its really not that important.

It becomes extremely important when this "just a phone" will be solely responsible for pulling in several billion dollars in profit for the company selling it.

You know how many attack lawyers that kind of money can buy?

Time to get worried for Gizmodo, I'd say. Hope they burn good for this.

Gizmodo is FAR from being innocent. They are a bunch of elitist spoiled-brats who expect the public to kiss their ass in order to be allowed to post comments on the site. They deliberately ignore all questions for help sent to them if they arbitrarily choose to.

I hope Apple rips Giz a brand new A-hole. That should knock their ego down a few notches. I want to see their ego in the mud...and so far, I am getting all that I want. That will no doubt cause the veins in their head to pop out. That's the kind of ppl they are.

I hope Apple brings criminal charges against Gizmodo and also multimillion dollar lawsuits. I hope Apple locks Gizmodo down and does to them what they do to innocent ppl.
